Question:
The first message in this episode is from Buraydah in the Qassim region, sent by the listener Hamad ibn Ahmad al-Ayyaf. He has a number of questions, one of which is: Does a person who is not accountable and whose senses are disturbed have any validity to their prayer if they pray, their fast if they fast, or their zakah if they give it? And is there any blame on them if they do not do so? May Allah reward you with good.
Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
One who has no sense, or whose intellect has departed, is not called an accountable person. The accountable person is the adult of sound mind; this is who is called an accountable person, whether male or female. As for one who is not an adult, or who has reached puberty but whose intellect has departed due to insanity or other causes of loss of intellect, he is not accountable. There is no prayer, fasting, or other obligations upon him, except for financial obligations. The financial obligation, such as zakah, must be paid out by his guardian. So if a lunar year passes over the wealth of a child or an insane person, it is obligatory for his guardian to pay its zakah. Likewise, if he destroys something belonging to people, the value of the destroyed item is obligatory from his wealth, because he has no intention. In this regard, the accountable person and the non-accountable person are equal. May Allah guide them all. Yes.
The presenter: O Allah, amen. May Allah reward you with good. Our brother is still following up on the same topic, saying: If one of his parents is treated by him in this state of disturbance, such as being cursed or beaten, is he punished by Allah or what? May Allah reward you with good.
The Shaykh: There is nothing upon him; there is no reward and no punishment due to the loss of intellect. So any of the sins that occur from him do not carry sin upon him because he is not accountable due to his lack of intellect. So if he curses, insults, or does any of the other forbidden things, there is no sin upon him as long as his intellect is stripped away, based on the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 2041Hasan (Darussalam) So if a sleeping person curses in his sleep, insults, or does any of the other matters, such as divorce or freeing a slave, what he does in his sleep is not considered, neither as an affirmation nor a negation, neither as a sin nor an obedience, because he is not accountable in this state; he has no intellect. Yes.
The presenter: May Allah reward you with good.
