The questioner : Some of my friends, with whom I often sit and spend some time, sometimes commit some religious violations on the road. So I remind them of the rights of the road that must be observed by those who sit on it, but they are stubborn and say that these are obligatory only for those who sit on the road, not for those who walk on it. What is your opinion on this? And what is the hadith that speaks about this meaning?

The Shaykh : Our view in this matter is that what they mentioned, namely that these rights were mentioned specifically for those who sit on the road and not for those who pass by it, is correct. They were mentioned for those who sit on the road, as the Prophet (peace and blessings be upon him) said:
Beware! Avoid sitting on he roads (ways). إياكم والجلوس على الطرقات
Sahih al-Bukhari 2465
or he said:
on the roads في الطرقات
They said, "O Messenger of Allah, these are our sitting places; we have no choice but to sit there and talk." He said:
Well, if you insist (on that) give the road its due rights. فإن أبيتم فأعطوا الطريق حقه
Bulugh al-Maram 16:85
They said, "What is its right, O Messenger of Allah?" He said:
Lowering the eyes, removing anything offensive, returning salutation, commanding what is reputable and forbidding what is disreputable. غض البصر وكف الأذى ورد السلام والأمر بالمعروف والنهي عن المنكر

The Shaykh : And although these five rights were mentioned in the hadith regarding those who sit on the road, they are obligatory even for those who pass by the road. Lowering the gaze, restraining from harm, returning the greeting, enjoining good, and forbidding evil are obligatory for everyone. Everyone must restrain from harm, lower his gaze from what is not permissible to look at, return the greeting, enjoin good, and forbid evil. If these companions comply with what I have forbidden them from and leave it, that is better for you and for them, and you should continue to keep their company if they enjoin good and refrain from evil. However, if they persist in what they are doing and do not abandon what Allah has forbidden them from, such as these things and others greater than them, then it is not permissible for you to keep their company, because the companion of one who does evil has the ruling of the doer, as Allah the Exalted said:
And it has already come down to you in the Book that when you hear the verses of Allah [recited], they are denied [by them] and ridiculed; so do not sit with them until they enter into another conversation وقد نزل عليكم في الكتاب أن إذا سمعتم ءايات الله يُكفر بها ويستهزأ بها فلا تقعدوا معهم حتى يخوضوا في حديث غيره
[An-Nisa 4:140]

He who amongst you sees something abominable should modify it with the help of his hand; and if he has not strength enough to do it, then he should do it with his tongue, and if he has not strength enough to do it, (even) then he should (abhor it) from his heart من رأى منكم منكراً فليغيّره بيده فإن لم يستطع فبلسانه فإن لم يستطع فبقلبه

. Some people understand from this hadith that if one sits with those who do evil while hating that evil in his heart, he is safe from it. This is a wrong understanding, because one who hates something in his heart cannot remain in a place or in a state that he hates, if he is sincere. If he is sincere, he would leave them. Therefore, separating oneself from the doer of evil is the disapproval by the heart, because that is its sign. But if you sit with them and say, "I hate what they are doing," that contradicts reality, which is your sitting with the people of evil. It is not possible to disapprove by the heart except by leaving the place of sin and the one who commits that sin. Yes.
