Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. And after that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the honorable head of the Mughayil Asir Court, number (645), dated 22/2/1417 AH, accompanied by the inquiry submitted by the head of the Mughayil Asir Municipality, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars, number (1238), dated 29/2/1417 AH. His Excellency asked a question, the text of which is as follows: We are attaching the summons submitted by the citizen (H. A. Sh.), which includes his request to remove the trees located in the cemetery adjacent to his commercial and residential shops in Mughayil.
He states that this cemetery has become full of dense trees and poses a danger to the tenants due to the proliferation of snakes in that cemetery. It has become a source of anxiety and nuisance, and the trees have covered the electricity poles. The Municipality wishes to clean all the cemeteries from the inside throughout the city. Therefore, we hope you will express your legal opinion on the extent to which it is possible to use equipment in those locations, given the density of the trees and the inability to use human hands due to the density, as well as the concern for the safety of the workers from what they may be exposed to from snakes and the like. May Allah preserve you.

A: It answered that there is no harm in cutting the trees located in graveyards that pose a harm, on the condition that their removal is done with hand tools to preserve the sanctity of the deceased, and that equipment does not enter the cemetery; because its entry causes the humiliation of the deceased. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
