Q 1: A relative of ours passed away, and he had a debt consisting of car installments. Our question is: Do those installments become due immediately upon his death, requiring immediate payment, or does the matter remain deferred? Please inform us, may Allah reward you.
A 1: If a person dies and has a debt payable in deferred installments, and the heirs secure the rights of the creditors with a pledge or a solvent guarantor, then the installments continue as they are, and there is no obligation to pay them except at the time to which they were deferred. However, if the heirs do not commit to this, the debt becomes due from the time of the debtor's death. The heirs of the deceased should hasten to pay off the debts of their deceased relative, either from his estate if he left wealth, or from their own wealth if they are able to do so. This is to clear the deceased's conscience and free his neck from his debts and the rights of people; for the deceased is suspended by his debt until it is paid off on his behalf. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
