The Shaykh : We say that if the heirs are satisfied with a pledged item or a guarantor, the debt remains as it is and does not become due. If they are not satisfied, the debt becomes due and it is obligatory to pay it.

The questioner : A question about bank installments for a deceased person?

The Shaykh : If they do not need it, it is better that they sell it to clear the deceased's liability. If they do need it, we look to see if there are any installments he did not pay—meaning, on the deceased. If it is said yes, we say it must be sold, or you [should sell it], because his soul is suspended by it. If they say no, and all the installments that became due during his life have been paid, then in this case we say there is no harm in it remaining mortgaged to the bank and being paid off each year.
