The presence of a mosque beneath a residence

Machine translationRead the Arabic original
Fatwa number ( 19412 )
Q: I built a house, and the intention was fixed before construction to build a mosque under the house. The construction was completed, the qiblah was determined, the mosque’s private restrooms were built, and the carpentry work was finished, with only the painting remaining. The mosque has taken on an Islamic form. I heard from some people that a mosque under a house is not permissible, so I stopped living in the house and operating the mosque for five years until a ruling was issued. What is your opinion, Your Eminence, regarding building a mosque under a house ? Please note that other small mosques were built nearby during this period, and the number of small mosques has increased. Please inform us, may Allah reward you with good.
A: There is no harm in a mosque being under a residence if the mosque and the residence were originally built in this configuration, or if the mosque was established under the residence. However, if the establishment of the residence above the mosque is a later addition, then this is not permissible, because its roof and what is above it are subordinate to it.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
