Q: In our village in the Arab Republic of Egypt there are six (6) mosques distributed throughout the village. I own a vacant plot of land that is approximately 700 meters from the nearest of these two mosques, and there are about fifteen hundred Muslims around this plot. I would like to build a private residence on this plot, but I wish to dedicate the ground floor as a mosque for this area, and the second floor and above as my private residence or for rent. The question is: Is it permissible to build a private residence or rental unit above the mosque ? It is known that the mosque contains the Book of Allah (the Noble Qur'an) and books of Islamic jurisprudence and hadith.
A: If this land is not an endowment for the mosque, and you own it as private property, there is no harm in building it with two or more floors, designating the ground floor as a mosque for the neighborhood you live in, and making the second floor and above your private residence or for rental. This is because the intention is to build the mosque and the residence in this configuration, and the public benefit in doing so is stronger due to the need of the neighborhood's residents for a mosque.
