The Story of Thalabah ibn Hatib

Q: The newspaper (Al-Ittihad) published in its special Ramadan supplement, in the competition "Names Preserved by the Qur'an," question No. (22), the substance of which is that a Companion asked the Messenger of Allah (peace and blessings be upon him) to call upon Allah to grant him wealth. When he became wealthy, the Messenger of Allah (peace and blessings be upon him) sent to him demanding the zakah, but he did not pay it. When the Messenger of Allah (peace and blessings be upon him) passed away, this Companion sent the zakah to Abu Bakr , but he did not accept it. In the time of 'Umar , the Companion sent the zakah to 'Umar , but he did not accept it. Then he died in the time of 'Uthman . What is the story of this Companion? And is it true? If so, should not a fatwa be issued worldwide to refute or confirm it?
A: Thalabah ibn Hatib, also known as ibn Abi Hatib al-Awsi al-Ansari , one of the Companions of the Messenger of Allah (peace and blessings be upon him), who witnessed Badr and Uhud . He (may Allah be pleased with him) is innocent of what has been attributed to him, namely that he came to the Prophet (peace and blessings be upon him) and asked him to call upon Allah for wealth for him. The Prophet (peace and blessings be upon him) made the supplication for him, and Allah made him wealthy, but he withheld the zakah, and the verse of repentance was revealed concerning him.
This story was narrated by al-Tabarani in (al-Mu'jam al-Kabir 8\260, No. 7873) through the chain of Ma'an ibn Rifa'ah from 'Ali ibn Yazid al-Ahna' , from al-Qasim ibn 'Abd al-Rahman , from Abu Umamah : that Thalabah ibn Hatib [did so], and he mentioned it. Through this chain, Ibn Jarir related it in (Tafsir) and in (Tarikh), and those after him relied on him in relating it, both in its extended and abbreviated forms, as the reason for the revelation of the word of Allah the Exalted:
And among them are those who made a covenant with Allahوَمِنْهُمْ مَنْ عَاهَدَ اللَّهَ لَئِنْ آتَانَا مِنْ فَضْلِهِ
[At-Tawbah 9:75]
the verse. Some related it and remained silent about its chain, such as Ibn Kathir (may Allah have mercy on him) in (his Tafsir). Some spoke about its invalidity, among them al-Qurtubi in (his Tafsir 8\209), who said: ( Thalabah was a participant in Badr, close to the Prophet, and one of those for whom Allah and His Messenger (peace and blessings be upon him) testified to faith, so what is narrated about him is not authentic ). He transmitted from Ibn 'Abd al-Barr that it is not authentic. al-Bayhaqi said in (Dalail al-Nubuwwah): (There is a problem with the chain of this hadith, and it is well-known among the people of tafsir). Ibn Hajar said in (al-Isabah): (There is a problem with the idea that the person in this story - if the report is authentic, and I do not think it is - is the aforementioned participant in Badr... And it is established that the Prophet (peace and blessings be upon him) said:
No one of those who took the oath of allegiance under the tree will go to hell.لا يدخل النار أحد ممن شهد بدرًا والحديبية

And he reported that his Lord the Exalted said to the people of Badr:
Do what you wish, I have forgiven you.اعملوا ما شئتم فقد غفرت لكم

. So how could one who is of this status be followed by hypocrisy in his heart, and what was revealed be revealed concerning him? It appears that it was someone else, and Allah knows best ) end of quote ( 1\198 ). He said in (Takhrij Ahadith al-Kashshaf): (This is a very weak chain). He said in (al-Fath): ( Ibn al-Athir asserted in (Tarikh) that the first obligation of zakah was in the ninth year... Some strengthened what Ibn al-Athir held by what occurred in the extended story of Thalabah ibn Hatib ... But it is a weak hadith that cannot be used as evidence ). Ibn Hazm ruled it invalid in (al-Muhalla 11\207-208). al-Dhahabi said in (Tajrid Asma' al-Sahabah 1\66) in the biography of Thalabah

, after referring to this story: (They mentioned a denounced hadith once). Then al-Tabari related it in (his Tarikh 3\124) from Ibn 'Abbas with a continuous chain through the al-'Awfi family from Muhammad ibn Sa'd al-'Awfi , from his father, from his uncle, from his father, from his uncle, from his father: 'Atiyyah ibn Sa'd al-'Awfi , and 'Atiyyah is weak. The conclusion is that this story is not authentic, and its text contains what refutes it, for the guidance of the Prophet (peace and blessings be upon him) was to take the zakah from the one who withholds it by force, along with punishing him for withholding it. It is established from him (peace and blessings be upon him) from the hadith of Bahz ibn Hakim from his father from his grandfather, that he (peace and blessings be upon him) said:
In every grazing camel, for every forty camels, there is a bint labun, and camels are not to be separated from their calculation. Whoever gives it, seeking reward, will have its reward, and whoever withholds it, We will take it and half of his wealth, a determination from the determinations of our Lord, Mighty and Majestic, and nothing of it belongs to the family of Muhammad (peace and blessings be upon him)في كل سائمة إبل في كل أربعين بنت لبون لا تفرق إبل عن حسابها، من أعطاها مؤتجرًا بها فله أجرها، ومن منعها فإنا آخذوها وشطر ماله عزمة من عزمات ربنا عز وجل، ليس لآل محمد صلى الله عليه وسلم منها شيء

Narrated by Ahmad and Abu Dawud and al-Nasa'i . What is in the story contradicts this guidance, so it is invalid in both chain and text. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
