The questioner : A girl grew up in a family that is Muslim in name, but their actions contradict Islam. The mother is immodest in her dress and does not pray, and the father likewise does not pray. The brother brings his strange friends and tries to force his sister to sit with them and serve them drinks while they are gambling, among other things.

The questioner : When this girl got to know a righteous young man, she veiled herself and became upright, and she asked him to save her from this corrupt environment. He proposed to her and sought to marry her, and he was suitable for her, but they rejected him completely. He presented this matter to the official marriage officer, who agreed to contract the marriage for him. In fact, he contracted the marriage for him without the knowledge of her family. Two friends of the young man testified to this after hearing from him and the girl about the circumstances of her family, their nature, and their refusal of the marriage. The marriage took place despite the family's objection. Years passed, circumstances changed, and her mother was afflicted with illnesses. The girl and her husband felt compassion for the mother and the family. Hatred turned into love, and disobedience to the family turned into obedience. They began to reform themselves and return to Allah. What is the ruling of the Shari'ah regarding this marriage, and is there any sin on the witnesses for that?

The Shaykh : This marriage contracted through the official marriage officer appears to me that the official marriage officer would not proceed with the contract unless he had fulfilled its Shari'ah conditions. On this basis, I cannot say that this contract is defective. However, as a general rule, if it happens that the guardians who are the most entitled people to marry off the woman are not fit for guardianship, then the guardianship transfers to those after them among the residuary heirs. If it happens that the husband's father, or more correctly the woman's father, does not pray, neither in the mosque nor in his home, then the guardianship transfers to her full brothers or her brothers on the father's side. If she has no brothers, it transfers to her paternal uncles. If she has no paternal uncles, it transfers to her paternal cousins, and so on in the order of the residuary heirs, as is known among the scholars.
As for this specific issue that this brother asked about, I am unable to issue a fatwa on it with anything, because it was carried out by a person who is considered valid in terms of Shari'ah and judgment.
