The Shaykh : Yes, if a man proposes to a woman and is suitable in his religion and character, and she is pleased with him and her brothers are pleased with him, then she may marry him. And whoever among them opposes it, his opposition is not heeded, even if he is the specific guardian, for he has no right to prevent her from marrying a suitable man. In this case, she may refer the matter to the judicial authority in order to appoint one of her guardians to marry her off.
As for if they are brothers, and all of them are full brothers, then each one of them is a guardian in his own right, without needing an appointment or going to the judge. So if her older brother refuses to marry her off except with this purely material condition, then the rest of her adult brothers, in whom the conditions of guardianship are met, each of them has the right to marry her off.
