The second question of Fatwa No. ( 19314 )
Q 2: A man had a female relative who became pregnant as a result of unlawful sexual intercourse. When he learned of this, his anger was aroused, and because he wanted to avoid a scandal for the family to which he belonged, he incited her to abort the fetus. She carried out his instructions, but to no avail; the child was not born except fully formed. It is known that she is not one of his mahram (relatives one may not marry). Among his incitement of her was that she informed him that she was trying to abort
The child before the end of the pregnancy, but to no avail, so what he mentioned to her was that she must get rid of that fetus in any way possible, even if it is born fully developed, and what she did was kill that child immediately after its birth and bury it. She would have done so whether that man incited her or not, but Satan led her astray to conspire with him. What is his obligation, does he have a repentance, and is he a partner in the sin?
A 2 : First: Unlawful sexual intercourse is forbidden by the Book, the Sunnah, and the consensus of the Muslims. Whoever commits it must repent from it under the following conditions: 1 - Abandoning it. 2 - Feeling remorse for his action. 3 - Not returning to it in the future. Along with striving to perform the obligatory acts, abandoning other sins and wrongs, and increasing in seeking forgiveness and voluntary acts of obedience, for good deeds erase bad ones. Second: Intentional killing is among the greatest of major sins, and it is forbidden by the Book and the Sunnah. What this woman did by killing her child is the intentional killing of a protected soul, and it is among the major sins. Therefore, it is obligatory for her to hasten to sincere repentance from this heinous crime, so that perhaps Allah will forgive her and accept her repentance. Third: What this man did by inciting the disposal of the fetus is considered participation in sin and aggression. It is obligatory for him to repent sincerely from this action, and not to advise any person in the future except with good.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
