Question: A person performed 'Umrah in the months of Hajj, such as the month of Dhu al-Qa'dah, then left Makkah for Madinah and stayed there until the time for Hajj. Is it obligatory for him to perform tamattu'? Or is he given the choice between one of the three types of Hajj?
Answer: It is obligatory for him to perform tamattu'. If he wishes to perform another 'Umrah and thereby be a person performing tamattu' according to those who say that his first tamattu' is severed by travel, there is no harm in that, and he will be a person performing tamattu' with his new 'Umrah. He owes the sacrificial animal according to all scholars if he performs 'Umrah from Madinah and then performs Hajj afterwards, as he will be a person performing tamattu' according to all scholars. If he wishes, he may return to perform Hajj only, and there is a difference of opinion on whether he should offer a sacrifice or not. The correct view is that he should offer a sacrifice, because his travel to Madinah does not sever his tamattu' according to the most correct of the opinions.
