The questioner : He says: A man from Africa performed 'Umrah during the months of Hajj. Then he went to Madinah to wait for Hajj. Is this considered tamattu'?

The Shaykh : We do not know. If he returned with an 'Umrah, he becomes one who performs tamattu' with the last 'Umrah. If he returned with Hajj by entering the state of ihram for Hajj from Dhu al-Hulayfah, some scholars said that he is one who performs ifrad, because he separated between Hajj and 'Umrah with travel. The correct view is that he is not one who performs ifrad, but rather he is one who performs tamattu', because the travel that breaks tamattu' is for a person to travel to his home country. As for traveling to another country, he is not one who performs tamattu', because he is still in his first journey. Since a person who travels to Makkah from his home country is a traveler until he returns to his home country, his travel from Makkah to Madinah and from Madinah to Makkah is considered one journey. In summary: if he is from Africa and performed 'Umrah during the months of Hajj, went to Madinah, and returned from Madinah in the state of ihram for Hajj or a new 'Umrah, he remains one who performs tamattu'. He owes the sacrificial animal for tamattu'. If he does not find one, he fasts three days during Hajj and seven days when he returns to his family.
