Q: A man performed 'Umrah in the month of Dhu al-Qa'dah of this year, 1416 AH, then returned to his home and family in al-Madinah al-Munawwarah after completing his 'Umrah. On the date 7/12/1416 AH, he went to the miqat and entered the state of ihram from the miqat of the people of al-Madinah with the intention of Hajj only. When he reached Makkah , one of his companions told him: "You are still in the state of tamattu' from your previous 'Umrah, and you must take off your ihram clothes and put them on the Day of Tarwiyah, like one performing tamattu'." He actually took off his ihram clothes and cut his nails, but did not perform tawaf or sa'y, relying on what the one who gave him the fatwa said, namely that he was still in the state of tamattu'. On the Day of Tarwiyah, he put on his ihram clothes, recited the talbiyah for Hajj, brought the sacrificial animal with him, and performed the tawaf and sa'y of Hajj on the Day of 'Eid, completing the rest of his rituals. The question is: Is the fatwa given to the aforementioned person valid? If it is not valid, what is required of the pilgrim and what is required of the one who gave him the fatwa? It is known that the 'Umrah performed by the aforementioned person in the months of Hajj was not intended for tamattu', but rather he intended a simple 'Umrah.

His exiting the state of ihram before the Day of Tarwiyah was a mistake, and what that person gave him as a fatwa is not correct. He owes nothing for wearing sewn clothes, covering the head, and cutting the nails due to his ignorance of the ruling. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
