Domes in graveyards that are not visited: should they be demolished?

Machine translationRead the Arabic original
The second question of Fatwa No. ( 18149 )
Q2: There are domes in the middle of the graveyards in our village, which are built visibly with a high elevation of about 10 feet or more. The people of the area do not enter them, nor do they hold any beliefs regarding them. We advised them to demolish them, and they said: "These domes are like historical monuments and are inside the graveyard fence, and no one visits them. Why are we demolishing them..." and they refused... We ask Your Eminence to kindly issue a written fatwa so that we can present the fatwa to the officials in
the country? To carry out what Your Eminence rules.

A2: It is obligatory for the rulers of the Muslims to demolish the domes built over graves; because they are among the means of shirk (associating partners with Allah). The Prophet (peace and blessings be upon him) said to the Commander of the Faithful 'Ali ibn Abi Talib (may Allah be pleased with him):
Spare no portrait unwiped out, and leave not a high grave unlevelled.لا تدع صورة إلا طمستها ولا قبرًا مشرفًا إلا سويته
Riyad as-Salihin 1687
, and it is established from the Prophet (peace and blessings be upon him) that he:
Allah's Messenger (ﷺ) forbade that the graves should be plastered or they be used as sitting places (for the people), or a building should be built over them.نهى أن يجصص القبر، وأن يقعد عليه، وأن يبنى عليه
Sahih Muslim 970a
narrated by Muslim in his (Sahih) from the hadith of Jabir ibn 'Abd Allah al-Ansari (may Allah be pleased with them both), and he (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى، اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
Agreed upon as authentic. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
