The first question of Fatwa No. ( 16072 )
Q1: I have an uncle whose father passed away a long time ago. He says: His father used to fast and pray, but he would slaughter for other than Allah. His father fell ill three months before his death; he suffered a deep wound in his private parts that confined him to bed for three months. He did not pray a single rak'ah, and then he died at the end of that period. He was ignorant that prayer is obligatory upon the sick person. My uncle is now blind and asks: Is it permissible for him to perform Hajj on behalf of his father, or not?
A1 : If your uncle's father died while slaughtering for other than Allah and did not repent from that until he died, along with his abandonment of prayer during his illness, then he is considered a mushrik (one who associates partners with Allah), and Hajj is not performed on his behalf; due to the saying of Allah (Mighty and Majestic):[Al-An'am 6:88] , and the saying of the Prophet (peace and blessings be upon him): .
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

But if they had associated others with Allah, then worthless for them would be whatever they were doing.
وَلَوْ أَشْرَكُوا لَحَبِطَ عَنْهُمْ مَا كَانُوا يَعْمَلُونَBetween a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.
بين الرجل وبين الكفر والشرك ترك الصلاةAnd success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
