Q 3: The honorable Shaykh: Whatis the ruling on reconciling people by means other than the judgment of the Qur'an and the Sunnah, if it quiets a blood feud or ends a dispute
A 3: If reconciling people leads to committing a forbidden act or resorting to man-made laws that contradict the Book of Allah and the Sunnah of His Messenger, then that is not permissible; because Allah the Exalted said:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ
[Al-Ma'idah 5:44]
, so it is obligatory for the one who reconciles people to reconcile them with justice, and to urge them to follow the truth, abandon oppression, and pardon their opponent with a good manner and kind words. Reconciliation between people may also be achieved by paying money to one of the disputing parties or to both, such as paying zakah to those in debt, or paying money to them or to others other than zakah, if he sees that
money is more beneficial and effective than words, and he will have reward and recompense for that. And it is obligatory for the one who reconciles people to fear Allah in his work, and for this reason Allah began with taqwa before reconciling between relatives, so He the Exalted said:
So fear Allah and amend that which is between you and obey Allah and His Messenger, if you should be believers.فَاتَّقُوا اللَّهَ وَأَصْلِحُوا ذَاتَ بَيْنِكُمْ وَأَطِيعُوا اللَّهَ وَرَسُولَهُ إِنْ كُنْتُمْ مُؤْمِنِينَ
[Al-Anfal 8:1]
, and He the Exalted said:
And if two factions among the believers should fight, then make settlement between the twoوَإِنْ طَائِفَتَانِ مِنَ الْمُؤْمِنِينَ اقْتَتَلُوا فَأَصْلِحُوا بَيْنَهُمَا
[Al-Hujurat 49:9]
up to His saying:
And if it returns, then make settlement between them in justice and act justly. Indeed, Allah loves those who act justly. (10) The believers are but brothers, so make settlement between your brothers. And fear Allah that you may receive mercy.فَإِنْ فَاءَتْ فَأَصْلِحُوا بَيْنَهُمَا بِالْعَدْلِ وَأَقْسِطُوا إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ (9) إِنَّمَا الْمُؤْمِنُونَ إِخْوَةٌ فَأَصْلِحُوا بَيْنَ أَخَوَيْكُمْ وَاتَّقُوا اللَّهَ لَعَلَّكُمْ تُرْحَمُونَ
[Al-Hujurat 49:9-10]
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
