Q: If a cow’s delivery becomes difficult, and the fetus becomes a danger to the mother’s life, where it performs movements that are dangerous to the mother’s life and to its own life, so that its owner is compelled to slaughter the young one before the delivery is completed, is this young one lawful, and is there no sin on its owner? And if the young one is slaughtered before it reaches one month of age, is it lawful?
A: Any animal that is slaughtered, whether young or old, in the manner prescribed by the Shari'ah, and which is alive at the time of slaughter, is lawful, by the saying of Allah the Exalted:
[Al-Ma'idah 5:3] to His saying: [Al-Ma'idah 5:3] This is ritually slaughtered, so it is lawful. As for the ruling on slaughtering the fetus before its delivery is completed, there is no harm in it, provided that this does not involve tormenting the mother. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُProhibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death], and those which are sacrificed on stone altars, and [prohibited is] that you seek decision through divining arrows. That is grave disobedience. This day those who disbelieve have despaired of [defeating] your religion; so fear them not, but fear Me. This day I have perfected for you your religion and completed My favor upon you and have approved for you Islam as religion. But whoever is forced by severe hunger with no inclination to sin - then indeed, Allah is Forgiving and Merciful.
