Q13: When we slaughter the sacrificial animal, we mention the name of Allah and say Allahu Akbar, and in this there is some conformity that makes it forbidden. Is this permissible or not? Please inform us, may Allah reward you with good.
A13: It is obligatory to mention the name of Allah when slaughtering the sacrificial animal, along with the dhikr, as established from the Prophet (peace and blessings be upon him). Whoever forbids the sacrificial animal on which the name of Allah has been mentioned has contradicted the Book of Allah the Exalted, and has departed from the community of Muslims and joined
the disbelievers; for Allah the Exalted said:
So eat of that [meat] upon which the name of Allah has been mentionedفَكُلُوا مِمَّا ذُكِرَ اسْمُ اللَّهِ عَلَيْهِ
[Al-An'am 6:118]
And do not eat of that upon which the name of Allah has not been mentioned, for indeed, it is grave disobedience.وَلاَ تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ وَإِنَّهُ لَفِسْقٌ
[Al-An'am 6:121]
, and it is established from the Prophet (peace and blessings be upon him) that he said:
Whoever bears witness to La ilaha illallah (there is none worthy of worship except Allah) and that Muhammad is the Messenger of Allah [SAW], faces our Qiblah, prays as we pray, and eats our slaughtered animals, he is a Muslim, and has the same rights and obligations as the Muslims.من شهد أن لا إله إلا الله واستقبل قبلتنا وصلى صلاتنا وأكل ذبيحتنا فهو المسلم، له ما للمسلم وعليه ما على المسلم
Sunan an-Nasa'i 3968Sahih (Darussalam)
narrated by al-Bukhari in (his Sahih). Al-Hafiz Ibn Rajab said in his commentary on this hadith in (Fath al-Bari), the text of which is: (And his mention of eating the sacrificial animal of the Muslims is an indication that it is necessary to adhere to all the apparent legislations of Islam, and among the greatest of them is: eating the sacrificial animal of the Muslims and conforming with them in their slaughter. So whoever refuses to do that is not a Muslim. And the Prophet (peace and blessings be upon him) would sometimes test those who enter Islam, and he would see in their former religion the refusal to eat some of the sacrificial animal of the Muslims, so he would feed them what they had refused to eat to verify thereby their Islam) end of quote,
Refraining from eating part of a Muslim's slaughtered animal by feeding it what he had refrained from eating, so that his Islam is thereby confirmed) [end of quote],
And the Prophet (peace and blessings be upon him) used to say when slaughtering: Bismillah, Allahu Akbarوكان النبي صلى الله عليه وسلم عند الذبح يقول: بسم الله والله أكبر
Therefore, it is obligatory to follow his example in this matter. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
