Q: Among us, people take oaths by al-Bukhari, so when someone loses hope of his Muslim brother being held accountable, he makes him swear on al-Bukhari and not on the Book of Allah, because if the Book of Allah is presented to him, he swears by it falsely, and his soul is at complete ease, whereas if the Book of al-Bukhari is placed before him, he is unable to utter a falsehood. What is the ruling on those who swear on al-Bukhari and do not swear by the Book of Allah?
A: Swearing on the mushaf or on (Sahih al-Bukhari ) has no basis in the Shari'ah; rather, it is the practice of some ignorant people. It is obligatory to abandon this custom, and to magnify the oath by Allah (Mighty and Majestic) without doing so on the mushaf or (Sahih al-Bukhari ) or anything else. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
