The second question of Fatwa No. ( 12977 )
Q2: We have a woman who swore by Allah several times that she would not
marry so-and-so. This man, after proposing to her and contracting the marriage, did not enter upon her. She swore by Allah that she would not marry him, but because her father and her brothers forced her, he entered upon her. She is now asking whether her marriage and contract are valid or not, and if they are not valid, what should she do? She is currently seven months pregnant. We ask for the answer with evidence. May you be rewarded, and peace be upon you.

A2: It is obligatory for the aforementioned woman, who swore repeatedly not to marry so-and-so and then married him, to pay the expiation for an oath. This is: feeding ten poor people, or clothing them, or freeing a believing slave. If she does not find the means to do so, she must fast for three days. Her marriage contract is valid if its pillars and conditions are complete and its impediments are absent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
