Oath to Marry a Second Wife

Machine translationRead the Arabic original
Fatwa No. ( 5755 )
Q: I ama married man with three children, and I am a man who has sworn an oath, which is an oath by Allah that I will marry another woman, and then I repeated that, so I want you to issue a ruling for me: Is marriage obligatory for me, or is there a Shari'ah provision that permits me not to do so? I am embarrassed for the sake of my children, and I fear disputes between me and them. If there is no hardship for me, I seek information about my religion; because it has happened to me several times, and I am, if Allah wills, absolutely determined to do so because of my religion. So I ask Allah, then you, to give me a written answer and explain it clearly.
A: What you swore to do, which is marriage, is good and desirable, and it leads to increasing the number of Muslims. However, if you do not fulfill your oath, you are obligated to pay the expiation for an oath, which is:
feeding ten poor people, or clothing them, or freeing a believing slave. If you cannot find the means to do so, fast for three days. This is based on the saying of Allah the Exalted:
Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave. But whoever cannot find [or afford it] - then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oathsلاَ يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ
[Al-Ma'idah 5:89]
the verse, and the saying of the Prophet (peace and blessings be upon him):
By Allah, Allah willing, if I ever take an oath, and then see that another is better than the first, I make expiration for my (dissolved) oath, and do what is better and make expiration.إني والله إن شاء الله لا أحلف على يمين فأرى غيرها خيرا منها إلا كفرت عن يميني وأتيت الذي هو خير
Sahih al-Bukhari 6718
or he said:
then I do what is better and make expiation for my oath.إلا أتيت الذي هو خير وكفرت عن يميني
Sahih al-Bukhari 6621
. It was narrated by al-Bukhari and Muslim . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
