Q: I have a daughter in al-Qasim who is currently 17 years old. When she was 4 years old, she fell severely ill, and her mother had great compassion for her. She vowed that if Allah cured her of this illness, she would not marry her off until she reached the age of twenty. We have contracted the marriage for the girl, but we stipulated to the groom that he not consummate the marriage until she reaches the age specified in the vow. The girl now has no impediment, but she said: "My mother has made a vow, and I do not want to burden her with what she cannot bear." It is known that she is currently suffering from a severe illness that has caused us great distress. It was said to us: "Marry her off, for this is a proven remedy for someone like her." We sought a ruling and were told: "The mother must expiate her oath by feeding sixty poor people or fasting for two months." Please give us a ruling, may Allah reward you with good.
A: If the matter is as described, the best course is for the man to whom she is contracted to consummate the marriage with her,
He made a vow for her, even if she had not reached twenty years of age, to remove the hardship from her and her family. Her mother owes an oath expiation, which is: feeding ten poor people, five sa' (a dry measure of about 3 kg) of wheat, dates, rice, or the like, distributed equally among them, or clothing them, or freeing a believing slave. If she cannot do so, she must fast for three days, and it is better if they are consecutive. Allah the Exalted said:
Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave. But whoever cannot find [or afford it] - then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oathsلاَ يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ
