Q: I have a cousin who is a classmate at school. We went on a school trip to some places, and my cousin went into the water to swim, so he drowned and died as a result. I vowed to Allah the Exalted that if He granted me safety, I would perform Hajj on his behalf, but I have not performed Hajj to this day. Am I obligated to perform Hajj on his behalf or not, and when does that obligation fall upon me?
A: If the matter is as you described, you must fulfill your vow if you are able, after you have performed Hajj for yourself, the Hajj of Islam, due to the saying of Allah the Exalted:
They [are those who] fulfill [their] vows and fear a Day whose evil will be widespread.يُوفُونَ بِالنَّذْرِ وَيَخَافُونَ يَوْمًا كَانَ شَرُّهُ مُسْتَطِيرًا
[Al-Insan 76:7]
, and the saying of the Messenger of Allah (peace and blessings be upon him):
Whoever vows that he will be obedient to Allah, should remain obedient to Himمن نذر أن يطيع الله فليطعه
Sahih al-Bukhari 6696
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
