And given the importance of this issue, we mention what is available of its evidence. Among the evidence for the disbelief of one who abandons prayer is the saying of Allah the Exalted regarding the polytheists: فإن تابوا وأقاموا الصلاة وءاتوا الزكاة فإخوانكم في الدين فعلق الله تعالى ثبوت الأخوة في الدين على أمور ثلاثة، التوبة من الشرك، وإقامة الصلاة وإيتاء الزكاة.

الشيخ : فإذا تخلّف أحد هذه الأوصاف لم يكونوا إخوة لنا في الدين ومن المعلوم أن الأخوة في الدين لا تنتفي بمجرد المعصية حتى ولو كانت من أكبر الكبائر فقتل المؤمن عمدا من أكبر كبائر الذنوب ومع ذلك لا يُخرج من الدين ولا تنتفي به الأخوة، يقول الله تعالى في ءاية القصاص : فمن عفي له من أخيه شيء فجعل الله تعالى القاتل أخاً للمقتول ويقول تعالى في ءاية قتال المؤمنين وإن طائفتان من المؤمنين اقتتلوا فأصلحوا بينهما إلى قوله : إنما المؤمنون إخوة فأصلحوا بين أخويكم فلم تنتفي الأخوة الإيمانية بقتال المؤمنين مع أن قتال المؤمنين كفر كما ثبت به الحديث الصحيح عن النبي صلى الله عليه وسلم في قوله : سباب المؤمن أو المسلم فسوق وقتاله كفر ، هذا واحد، الدليل الثاني قوله تعالى : فخلف من بعدهم خلف أضاعوا الصلاة واتبعوا الشهوات فسوف يلقون غياً إلا من تاب وءامن وعمل صالحاً فإن قوله إلا من تاب وءامن دليل على أنه حين إضاعة الصلاة ليس بمؤمن أما من السنّة فمن أدلتها ما ثبت في صحيح مسلم من حديث جابر رضي الله عنه أن النبي صلى الله عليه وسلم قال : بين الرجل وبين الشرك والكفر ترك الصلاة وفي السنن ... حديث بريدة ابن الحصيب رضي الله عنه أن النبي صلى الله عليه وسلم قال : العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر فجعل النبي عليه الصلاة والسلام العهد فاصلاً بيننا وبين الكفر وقال من تركها فقد كفر يعني وخرج من ربقة الإيمان وكذلك في حديث جابر قال : بين الرجل وبين الشرك والكفر ترك الصلاة فجعل تلك الصلاة هو الحائل بين الإيمان والكفر وقال الكفر بأل الدالة على الحقيقة فالمعنى بين الرجل وبين الكفر الحقيقي وهو المخرج عن الإيمان ترك الصلاة ومن أدلة السنّة أيضاً أن الرسول صلى الله عليه وسلم أمرنا أن نسمع ونطيع لولاة الأمور وأن لا ننازعهم الأمر إلا أن نرى كفراً بواحاً عندنا فيه برهان وسئل هل نُنابذ أئمة الجور قال لا ما صلوا فدل هذا على أنهم إذا تركوا الصلاة فلنا أن نُنابذهم وهذا يقتضي أن يكون ترك الصلاة كفراً بواحاً وهذا الاستدلال مركّب من دليلين وقال عبد الله ابن شقيق " كان أصحاب النبي صلى الله عليه وسلم لا يرون شيئا من الأعمال تركه كفر إلا الصلاة " وقد نقل بعض أهل العلم الإجماع على كفر تارك الصلاة وهو مروي عن جماعة من الصحابة رضي الله عنهم منهم عمر وابن مسعود رضي الله عنهما.
قال عمر رضي الله عنه : " لا حظ في الإسلام لمن ترك الصلاة " وحظ نكرة في صيغة النفي فيعم القليل والكثير أي لا حظ لا قليلاً ولا كثيرأً لمن ترك الصلاة في الإسلام، فهذه الأدلة تدل على أن تارك الصلاة كافراً كفرا مخرجاً عن الملة وفيه أدلة أخرى لا يتسع المقام لذكرها وقد تأملت الأدلة التي استدل بها من لا يروْن كفر تارك الصلاة فوجدتها تنقسم إلى أقسام منها ما لا دليل فيه أصلاً ومنها ما هو مقيّد بحال يُعذر فيها بترك الصلاة ومنها ما هو مقيّد بوصف لا يُمكن معه ترك الصلاة ومنها ما هو عام يكون مخصَّصاً بأدلة كفر تارك الصلاة ولم أجد لا في الكتاب ولا في السنّة نصاً يقول : إن تارك الصلاة مؤمن ولا يقول إن تارك الصلاة يدخل الجنة ولا يقول إن تارك الصلاة ينجو من النار وما أشبه ذلك مما يدل أو مما يجعلنا نحمل نصوص الكفر على أن المراد به كفر لا يُخرج من الملة، وإذا كان كذلك فإننا عبيد الله عز وجل يحكم فينا بما يشاء فإذا دل كتابه وسنّة رسوله صلى الله عليه وسلم على استحقاق وصف من الأوصاف فليس لنا أن نتهرّب منه بل علينا أن نثبته وإذا أثبتناه فإن الحكمة في إثباته ونحن إذا قلنا بكفر تارك الصلاة كفراً مخرجاً عن الملة كما هو مقتضى النصوص وأقوال الصحابة رضي الله عنهم فإننا بهذه المقالة نحمل الناس على الصلاة وكل انسان يخاف الله ويخشى من عقابه فإنه لا بد أن يصلي إذا علم أنه إذا تركها كفر كفراً مخرجاً عن الملة وترتبت عليه أحكام الكفر من انفساخ زوجته منه وعدم حِل ذبيحته ومنعه من دخول مكة وحرمها وعدم تغسيله إذا مات وعدم دفنه مع المسلمين وتحريم الدعاء له بالمغفرة والرحمة وما أشبه ذلك، كل إنسان له عقل إذا علم أن هذا الأمر يترتب على تركه للصلاة فإنه سوف يصلي لكننا إذا ذهبنا نلتمس التأويلات البعيدة للنصوص وقلنا إنه فاسق لا يكفر فسيتهاون بها ويتمادى في تهاونه ومن المعلوم أنه لا يُمكن لإنسان عرف أعمال القلوب لا يُمكنه أن يقول لشخص أو عن شخص حافظ على ترك الصلاة والتهاون بها وعدم المبالاة لا يمكن أن يقول عنه إن في قلبه شيئاً من الإيمان، كيف يكون في قلبه شيء من الإيمان وهو محافظ على ترك الصلاة يؤمر بها فلا يمتثل ويرى المسلمين يُصلون فلا يصلي وهو يعلم ما في الصلاة من الثواب العظيم والأجر الكثير وما في تركها من العذاب الأليم، أعتقد أن هذا لا يمكن أن يقع من شخص في قلبه أدنى مثقال حبة من الإيمان وعلى هذا فيكون ترك الصلاة لو لم يكن فيه نصوص خاصة بتكفير من تركها لكان كفره من باب اللوازم أي أن من حافظ على تركها فإن من لازم ذلك أن لا يكون في قلبه شيء من الإيمان.
هذه هي الأدلة التي تدل على كفر تارك الصلاة كفراً مخرجاً عن الملة والعياذ بالله وبناءً على ذلك فإن ذبيحته لا تحِل لأن ذبيحة غير المسلم لا تحل إلا إذا كان الذابح من أهل الكتاب اليهود والنصارى وتارك الصلاة من المسلمين مرتد فلا تحل ذبيحته، هذا هو خلاصة كلامي في هذه المسألة العظيمة المهمة التي يجب علينا جميعاً أن نتعاون فيها على البر والتقوى وأن نُلزم هؤلاء الذين تهاونوا بهذا الركن العظيم من أركان الإسلام بأن يقوموا به مخلصين لله متبعين لرسوله صلى الله عليه وسلم.
بقي أن يقال : قد يقول قائل : ذكرت في ءاية براءة فإن تابوا وأقاموا الصلاة وءاتوا الزكاة فإخوانكم في الدين أنه إذا تخلّف أحد الأوصاف الثلاثة لم يكن أخاً لنا في الدين وهذا يستلزم أن يكون كافراً لأن الأخوة في الدين لا تنتفي إلا بالكفر إذن فتارك الزكاة هل يكون كافراً؟ والجواب على ذلك أن يقال يرى بعض العلماء أن مانع الزكاة بُخلاً يكون كافراً كفراً مخرجاً عن الملة وهو رواية عن الإمام أحمد رحمه الله ولكن مع ذلك القول الراجح أنه لا يكفر ووجهه أن الرسول عليه الصلاة والسلام أخبر كما في صحيح مسلم من حديث أبي هريرة أن من منع زكاة ماله عذّب عليه بما ذكِر في الحديث قال : ثم يرى سبيله إما إلى الجنة وإما إلى النار وهذا الحديث يدل على أن من منع الزكاة بخلاً لا يكون كافراً لأن الكافر لا يمكن أن يرى سبيلاً له إلى الجنة وهذا الحديث يُخصّص مفهوم الأية الكريمة التي في صورة براءة.

السائل : جزاكم الله خيرا. If they repent, establish prayer, and give zakah, then they are your brothers in religion. So Allah the Exalted made the establishment of brotherhood in religion contingent upon three matters: repentance from shirk (associating partners with Allah), establishing prayer, and giving zakah. The questioner: Yes. The Shaykh: If one of these descriptions is lacking, they are not our brothers in religion. It is well known that brotherhood in religion is not negated by mere sin, even if it is from the greatest of major sins. For example, the intentional killing of a believer is among the greatest of major sins, and yet it does not take one out of the religion, nor does it negate brotherhood. Allah the Exalted says in the verse regarding qisas (retaliation in kind): "But if he forgives something to his brother, then..." So Allah the Exalted made the killer a brother to the one killed. And He says in the verse regarding the fighting of believers: "And if two groups among the believers fight, then make reconciliation between them..." until He says: "The believers are but brothers, so make reconciliation between your two brothers." So faith-based brotherhood is not negated by the fighting of believers, even though the fighting of believers is kufr (disbelief), as established by the authentic hadith from the Prophet (peace and blessings be upon him) in his saying: "Cursing a believer is fisq (open sinfulness), and fighting him is kufr." This is one point. The second piece of evidence is His saying: "Then there came after them successors who neglected prayer and followed desires, so they are going to meet al-Ghayy (the Ditch), except for one who repents and believes and does righteous deeds." So His saying "except for one who repents and believes" is evidence that when prayer is neglected, one is not a believer. As for the Sunnah, among its evidences is what is established in Sahih Muslim from the hadith of Jabir (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "Between a man and shirk and kufr is the abandonment of prayer." And in the Sunan... there is the hadith of Buraydah ibn al-Husayb (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "The covenant that is between us and them is prayer, so whoever abandons it has committed kufr." So the Prophet (peace and blessings be upon him) made the covenant the divider between us and kufr, and he said, "Whoever abandons it has committed kufr," meaning he has exited the bond of faith. And likewise in the hadith of Jabir, he said: "Between a man and shirk and kufr is the abandonment of prayer." So he made that prayer the barrier between faith and kufr. And he used the letter "al" (the) with kufr, which indicates reality, so the meaning is: between a man and real kufr, which is that which takes one out of faith, is the abandonment of prayer. And among the evidences from the Sunnah is also that the Messenger (peace and blessings be upon him) ordered us to listen and obey the rulers, and not to contest them in authority, except if we see clear kufr with us in which we have proof. And he was asked: "Do we confront the unjust imams?" He said: "No, as long as they pray." This indicates that if they abandon prayer, it is permissible for us to confront them. And this necessitates that abandoning prayer is clear kufr. And this argument is composed of two evidences. And Abdullah ibn Shuqayq said: "The Companions of the Prophet (peace and blessings be upon him) did not consider any of the deeds to be kufr if abandoned, except prayer." And some of the scholars of knowledge have transmitted the consensus (ijma') on the kufr of the one who abandons prayer, and it is narrated from a group of the Companions (may Allah be pleased with them), among them 'Umar and Ibn Mas'ud (may Allah be pleased with them both). 'Umar (may Allah be pleased with him) said: "There is no share in Islam for one who abandons prayer." And "share" (hazz) is an indefinite noun in the form of negation, so it encompasses the little and the much, meaning there is no share, neither little nor much, for one who abandons prayer in Islam. So these evidences indicate that the one who abandons prayer is a disbeliever with a kufr that takes him out of the religion. And there are other evidences for which the occasion does not allow mention. And I have examined the evidences by which those who do not consider the abandonment of prayer to be kufr have argued, and I found them to be divided into categories: some of them have no evidence at all; some are restricted to a state in which one is excused for abandoning prayer; some are restricted to a description with which abandoning prayer is not possible; and some are general, to be specified by the evidences of the kufr of the one who abandons prayer. And I did not find, neither in the Book nor in the Sunnah, a text that says: "The one who abandons prayer is a believer," nor that says: "The one who abandons prayer enters Paradise," nor that says: "The one who abandons prayer is saved from the Fire," or the like of that which indicates, or which makes us interpret the texts of kufr to mean a kufr that does not take one out of the religion. And if that is the case, then we are the slaves of Allah, Mighty and Majestic, and He rules over us as He wills. So if His Book and the Sunnah of His Messenger (peace and blessings be upon him) indicate the deserving of a description, it is not for us to evade it, but rather it is obligatory for us to affirm it. And if we affirm it, then there is wisdom in affirming it. And when we say that the one who abandons prayer commits a kufr that takes him out of the religion, as is the implication of the texts and the sayings of the Companions (may Allah be pleased with them), then with this statement we urge people to pray. And every person who fears Allah and is afraid of His punishment, if he knows that if he abandons it he will commit a kufr that takes him out of the religion, and the rulings of kufr will befall him—such as the annulment of his marriage, the impermissibility of his slaughtered meat, his being prevented from entering Makkah and its sacred precinct, not being washed when he dies, not being buried with the Muslims, and the prohibition of supplicating for him with forgiveness and mercy, and the like of that—then every person who has intellect, if he knows that this matter is a consequence of his abandoning prayer, he will pray. But if we go seeking distant interpretations of the texts and say that he is a fasiq (open sinner) who does not commit kufr, he will become lax in it and persist in his laxity. And it is well known that it is not possible for a person who knows the deeds of the hearts to say about a person, or to say of a person, that he is maintaining the abandonment of prayer and being lax in it and not caring, that there is anything of faith in his heart. How can there be anything of faith in his heart when he is maintaining the abandonment of prayer, he is ordered to do it but does not comply, he sees the Muslims praying but does not pray, and he knows what is in prayer of great reward and much reward, and what is in its abandonment of painful punishment? I believe that this cannot happen to a person in whose heart is the least weight of a mustard seed of faith. And on this basis, abandoning prayer, even if there were not specific texts regarding the takfir (declaring someone a disbeliever) of the one who abandons it, would be kufr by way of necessary implication, meaning that the one who maintains its abandonment, the necessary implication of that is that there is nothing of faith in his heart. These are the evidences that indicate the kufr of the one who abandons prayer with a kufr that takes him out of the religion, and I seek refuge in Allah from that. And based on that, his slaughtered meat is not permissible, because the slaughtered meat of a non-Muslim is not permissible except if the one who slaughters is from the People of the Book, the Jews and the Christians. And the one who abandons prayer from among the Muslims is an apostate, so his slaughtered meat is not permissible. This is the summary of my speech in this great and important issue in which we must all cooperate in righteousness and piety, and that we must compel those who have been lax in this great pillar of the pillars of Islam to perform it sincerely for Allah and following His Messenger (peace and blessings be upon him). It remains to be said: A person might say: You mentioned in the verse in Surah al-Bara'ah, "If they repent, establish prayer, and give zakah, then they are your brothers in religion," that if one of the three descriptions is lacking, he is not a brother to us in religion. And this necessitates that he is a disbeliever, because brotherhood in religion is not negated except by kufr. So is the one who withholds zakah a disbeliever? The answer to that is to say: Some scholars hold that the one who withholds zakah out of stinginess is a disbeliever with a kufr that takes him out of the religion, and it is a narration from Imam Ahmad (may Allah have mercy on him). But despite that, the stronger position is that he does not commit kufr. And its aspect is that the Messenger (peace and blessings be upon him) informed, as in Sahih Muslim from the hadith of Abu Hurayrah, that the one who withholds the zakah of his wealth will be punished with what is mentioned in the hadith. He said: "Then he will see his way, either to Paradise or to the Fire." And this hadith indicates that the one who withholds zakah out of stinginess is not a disbeliever, because a disbeliever cannot see a way for him to Paradise. And this hadith specifies the concept of the noble verse in the form of Surah al-Bara'ah. The questioner: Yes. The Shaykh: Yes. The questioner: May Allah reward you with good.
