A sister from Jizan, whose name is Du'a Jibril—as she named herself—asks a set of questions, five questions in fact. Your Eminence, in one of her questions she says: When we slaughter an animal, sometimes a man who does not pray, but is a Muslim, performs the slaughter. I have heard on this program that the one who does not pray is considered a disbeliever. So, is there a sin on me if I eat from the meat of this slaughtered animal? Please inform us, may Allah reward you.
Answer: The scholars, may Allah have mercy on them, differed regarding the man who abandons prayer while not denying its obligation; he knows that it is obligatory and that it is a duty upon him, but he is lax, so he prays at times and abandons prayer at other times, or he does not pray at all.
A group of scholars held that he has committed a great evil, greater than zina, greater than theft, and greater than undutifulness to parents, but he does not commit major disbelief, rather it is minor shirk (associating partners with Allah). This is what a group of scholars said, and based on this they said: his slaughter is permissible; because he remains a Muslim.
Others among the scholars held that he commits disbelief by this; whenever he abandons prayer intentionally, even if he does not deny its obligation, he commits disbelief by this. This is the correct position, this is the truth, and this is what is narrated from the Companions (may Allah be pleased with them) . Abdullah ibn Shaqiq al-Aqili, the noble Tabi'i, said:
The Companions of the Messenger of Allah (peace and blessings be upon him) did not consider any of the deeds to be such that abandoning it is disbelief, except prayer.لم يكن أصحاب رسول الله ﷺ يرون شيئاً من الأعمال تركه كفر إلا الصلاة
. So they considered abandoning prayer to be disbelief, even if he does not deny its obligation. And thus the Prophet (peace and blessings be upon him) said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر

, and he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
, narrated by Muslim in the Sahih. The authentic hadiths on this matter are numerous, indicating that whoever abandons it commits disbelief, even if he does not deny its obligation, whether he is a man or a woman.
This is the correct position, and with this, his slaughter is not permissible. If he slaughters an animal, his slaughter is carrion, like the slaughter of a Zoroastrian and his like. The slaughter of a Jew is permissible, and the slaughter of a Christian is permissible; because he is from the People of the Book. As for the slaughter of a disbeliever who abandons prayer, or worships the dead, or calls for aid to the dead, or insults the religion, or mocks the religion—these are disbelievers, more severe than the Jews and Christians. Their slaughter is not valid, not ritually slaughtered, and not permissible.
So one should be careful of this, and beware of being lax in this matter. As for the one who denies its obligation and says: "It is not obligatory," or mocks it, then he is a disbeliever according to all scholars. If he denies its obligation and mocks the praying people, considering them to be of deficient intellect for performing this prayer, then this is major shirk (associating partners with Allah), we seek refuge in Allah.
