Is it permissible to eat from the slaughter of one who abandons prayer?

Machine translationRead the Arabic original
Question:
What is the ruling regarding the slaughter of one who abandons prayer? Is it permissible to eat from it?

Answer:
The correct view is that one who intentionally abandons prayer, even out of laziness without denying its obligation, is a disbeliever with major shirk (associating partners with Allah). This is the correct view among the scholars. The evidence for this is the saying of the Prophet (peace and blessings be upon him) in the authentic hadith:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
And he (peace and blessings be upon him) said:
Between the man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر، والشرك ترك الصلاة
.
And he said regarding the bad rulers, when the Companions asked him about fighting them, he said:
unless we noticed him having open Kufr (disbelief) for which we would have a proof with us from Allahإلا إن تروا كفرًا بواحًا، عندكم من الله فيه برهان
Sahih al-Bukhari 7055, 7056
And in another wording:
as long as they establish prayer among youما أقاموا فيكم الصلاة
Sahih Muslim 1855a
.
This indicates that abandoning the establishment of prayer is open disbelief; because he equated it with open disbelief. Thus, it is known that not establishing prayer is open disbelief. He did not say that they denied prayer; he said that they did not establish it. Therefore, the one who abandons it and does not establish it is not among the Muslims. This is the correct position.
A group of scholars held that his disbelief is minor shirk (associating partners with Allah), not major shirk, and that his slaughter is permissible and his marriage to a Muslim woman is valid; because his disbelief is minor shirk, such as the slight disbelief of showing off in worship, or the disbelief of one who swears by other than Allah, such as one who slips into swearing by other than Allah, or one who says, "If it were not for Allah and so-and-so," or the like. They said that this is the meaning of the hadith, and that it does not mean he is a disbeliever with major shirk.
The correct view is the first one; because the Messenger used the word "disbelief" and used the definite article (al) between it and "shirk (associating partners with Allah)." The definite "disbelief" and the definite "shirk" refer to major shirk. And there are other evidences. Allah made prayer, on the tongue of His Prophet, the pillar of Islam.
The point is: that the one who abandons it, according to the most correct view, is a disbeliever with major shirk. Accordingly, his slaughter is not lawful; his slaughter is carrion. It is not recommended to eat with him, his invitation should not be accepted, the salam should not be returned to him, and he should be boycotted.
