The slaughter of one who abandons prayer

Fatwa number ( 1598 )
Q: If a man who has cut off prayer slaughters an animal, is it permissible for a person who prays to eat from that slaughter ?
A: Prayer is the most emphasized of the five pillars after the two testimonies. Whoever abandons it while denying its obligation is a disbeliever by the consensus of the Muslims. Whoever abandons it out of negligence or laziness, the correct opinion among the scholars is that he becomes a disbeliever. The basis for this is what Muslim narrated in his *Sahih* from the Prophet (peace and blessings be upon him) that he said:
Between man and polytheism and unbelief is the abandonment of salat.بين العبد وبين الشرك والكفر ترك الصلاة
Sahih Muslim 82b
, and what Imam Ahmad narrated in his *Musnad* and the people of the Sunan with a sound chain from the Prophet (peace and blessings be upon him) that he said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر
Sunan Ibn Majah 1079Sahih (Darussalam)
. Accordingly, if the person you asked about is one who abandons prayer by denying it, his slaughter is not eaten by consensus. If he abandons it out of negligence or laziness, then according to the opinion that he is a disbeliever, which is the more apparent view, it is not permissible to eat from what he slaughtered with his own hand; because he is an apostate, and the slaughter of an apostate is not eaten, as the scholars (may Allah have mercy on them) explicitly stated. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
