A son’s testimony against his father in a case of murder

Machine translationRead the Arabic original
Fatwa No. ( 21824 )
Q1: A young man saw his father killing a person without right, and his father ordered him to keep this secret, and if he disclosed it, his father would be angry with him for the rest of his life. After that, the police arrested an innocent person who had no guilt in this crime, so he remained for a period unable to disclose the secret, and he did not know what to do? Should he give truthful testimony and become (undutiful to his father) in his father’s eyes, or keep the secret and be a mute devil, or apply the law of Allah in the noble verses: In the name of Allah, the Most Gracious, the Most Merciful
But if they endeavor to make you associate with Me that of which you have no knowledge, do not obey them but accompany them in [this] world with appropriate kindnessوَإِنْ جَاهَدَاكَ عَلَى أَنْ تُشْرِكَ بِي مَا لَيْسَ لَكَ بِهِ عِلْمٌ فَلا تُطِعْهُمَا وَصَاحِبْهُمَا فِي الدُّنْيَا مَعْرُوفًا
[Luqman 31:15]
What should he do in these two matters?

A1: You must declare the truth that you know against your father and not conceal it; because Allah (Glorified and Exalted is He) says:
O you who have believed, be persistently standing firm in justice, witnesses for Allah, even if it be against yourselves or parents and relativesيَا أَيُّهَا الَّذِينَ آمَنُوا كُونُوا قَوَّامِينَ بِالْقِسْطِ شُهَدَاءَ لِلَّهِ وَلَوْ عَلَى أَنْفُسِكُمْ أَوِ الْوَالِدَيْنِ وَالأَقْرَبِينَ
[An-Nisa 4:135]
And this is not considered undutifulness to your father; because Allah has commanded it, and there is no obedience to a creation in disobedience to the Creator.
