Fatwa number ( 2838 )
Q: I wanted to propose to a Muslim girl, who is one of my relatives. When I proposed to her, her family agreed, but the girl's mother says that she was visiting my mother while I was an infant, and I was crying, so she wanted to silence me by breastfeeding me while my mother was absent. She put her breast to me, and she says that the infant (the questioner) did not suckle the breast, and at the same time she is not certain that milk came out , and she cannot confirm that milk reached my throat. She says that only drops of milk came from her breast. Does her daughter become forbidden to me based on what her mother says, and what is the amount and nature of the milk that makes marriage forbidden?
A: First : If the reality is as you described regarding the nature of the breastfeeding, it is permissible
for you to marry the daughter of the woman mentioned. Second : The breastfeeding that establishes prohibition is five known sucklings within the first two years; because of the saying of Allah the Exalted:
Mothers may breastfeed their children two complete years for whoever wishes to complete the nursing [period].وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَنْ يُتِمَّ الرَّضَاعَةَ
[Al-Baqarah 2:233]
, and because it is established from 'A'ishah (may Allah be pleased with her) that she said: Among what was revealed in the Qur'an was: (Ten known sucklings make marriage forbidden), then it was abrogated by: (Five known sucklings), and the Messenger of Allah (peace and blessings be upon him) passed away while the matter was still as such. Know that if a child sucks milk from the breast, even a little, and then stops, this is considered one suckling. If he returns to it and sucks milk, even a little, this is considered a second suckling, and so on. Likewise, if milk is dripped into his throat or nose and reaches his throat, and then the dripping is stopped, even for a short time, this is considered one suckling. If the dripping is resumed, even a little, this is considered a second suckling, and so on. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
