Q: I have an uncle, my father’s paternal uncle, who was left behind as an infant by his mother after a dispute with my grandfather, may Allah forgive him.
This led my mother, may Allah reward her, to take care of him because he was her husband’s brother, and because he was an infant who needed breastfeeding, and because she had no milk as she had not given birth. During that period, she breastfed him by deceiving him, where she would put drops of milk on her breast so that he would accept the breast and suckle. Now that my uncle has daughters of marriageable age, and my brothers wish to marry his daughters, is there anything that prevents them from marrying their uncle’s daughters? I ask for clarification, and may Allah preserve and protect you, and reward us with the best reward.

A: The breastfeeding that is forbidden is five breastfeedings or more within the first two years. So if your uncle’s breastfeeding from your mother’s milk was like that, he is her son through breastfeeding, and a brother to all her children. Therefore, it is not permissible for your brothers to marry your uncle’s daughters, because they are their brothers’ sisters through breastfeeding. Allah the Exalted said:
Prohibited to you [for marriage] are your mothers, your daughtersحُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ
[An-Nisa 4:23]
up to His saying:
your sisters through nursingوَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ
[An-Nisa 4:23]
, and He said:
Mothers may breastfeed their children two complete yearsوَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ
[Al-Baqarah 2:233]
, and it is established that the Prophet (peace and blessings be upon him) said:
What is rendered illegal because of blood relations, is also rendered illegal because of the corresponding foster-relations.الرضاعة تحرم ما تحرم الولادة
Sahih al-Bukhari 3105
, and it is established from the hadith of Aisha (may Allah be pleased with her) that she said:
What was revealed in the Qur'an was:
ten clear sucklings make the marriage unlawfulعشر رضعات معلومات يحرمن
Sahih Muslim 1452a
then it was abrogated by:
Five known sucklingsخمس معلومات
, and the Messenger of Allah (peace and blessings be upon him) passed away while the matter remained as such. Know that a single breastfeeding is when the child holds the breast and then sucks milk from it; if he leaves it and returns and sucks milk, that is a second breastfeeding, and so on. And if your mother gave your uncle the breast to quiet him and did not let him suck milk from her breast, there is no prohibition, and the marriage is permissible. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
