Q: I have a brother who had a daughter. When the mother wanted to go fetch water, and the need required her to be delayed, she would leave the girl with my mother and my brother. When the child would miss her mother and cry, my mother would take her and give her her breast until the girl would quiet down. She says that she did this several times. When she squeezes the tip of the breast, milk mixed with water comes out . My mother told me, when I asked her, that the amount of milk the girl suckled from her was about a small cup. My mother was in the last month of her pregnancy when she did this, and she was sitting for the birth. Is this girl permissible for my son to marry?
A: If the situation is as you described, that your mother breastfed your brother’s daughter several times, and that a small amount of milk mixed with water came out of her, then your brother’s daughter who suckled from your mother has become your sister through breastfeeding, and the aunt of your son, provided that the breastfeeding was five times or more within the first two years. Accordingly, it is not permissible for your son to marry this girl;
because of the saying of Allah the Exalted:[An-Nisa 4:23] up to His saying: [An-Nisa 4:23], and because of the established hadith of Aisha (may Allah be pleased with her), who said: “Among what was revealed in the Qur’an was: ‘Ten known breastfeedings make a woman forbidden.’ Then it was abrogated by: ‘Five known breastfeedings.’ The Messenger of Allah (peace and blessings be upon him) passed away while the matter remained as such.” If the breastfeeding was less than five times, or if it was after the two-year period, then it is permissible for your son to marry her. Know that if a child sucks milk from the breast, even a little, and then stops, this is considered one breastfeeding. If he returns to it and sucks milk from it, even a little, this is considered a second breastfeeding, and so on. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
