Fatwa number ( 3478 )
Q: I have proposed to my maternal uncle’s daughter (my mother’s brother’s daughter), but I was told that I had been breastfed by the girl’s grandmother, that is, my maternal uncle’s mother, who is an old woman from whom no milk has come out. I ask you, may Allah reward you, to issue a ruling on this matter?
A: If the matter is as stated in the question, namely that no milk came out of the grandmother from whom the questioner was breastfed, then it is permissible for him to marry the maternal uncle’s daughter mentioned in the question. However, it is necessary to confirm that no milk came out of her at the time he was breastfed by her, either through the wet nurse herself if she is still alive, or through someone who knew her at the time the questioner was breastfed by her. This is on the condition that the suckling was five times or more within the two-year period. If it was less than five times, it has no effect on prohibition; due to the hadith of Aisha (may Allah be pleased with her), who said: “It was among what was revealed in the Qur’an: ‘Ten known breastfeedings make [a woman] a mahram (forbidden to marry).’ Then this was abrogated by: ‘Five known [breastfeedings].’ The Messenger of Allah (peace and blessings be upon him) passed away while they were still among what was recited in the Qur’an.” Narrated by Muslim ,
and if it was after the two-year period, it has no effect on prohibition; due to the saying of Allah the Exalted:[Al-Baqarah 2:233] . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
