Q: He proposed to the daughter of his paternal cousin, and her father agreed, but her mother refused on the claim that she had previously breastfed him. When the matter was raised with her again, she expressed doubt about it and then said, "I do not know." It is mentioned that the marriage contract was concluded with the daughter of his paternal cousin, and he asks about its validity given the circumstances he described. .
A: Prohibition by breastfeeding does not occur except through certain conditions: First, its establishment. If there is doubt regarding its occurrence in general, it is not considered, as the original state is the absence of breastfeeding, and it is not permissible to deviate from the original state except by what the Shari'ah lifts it, and doubt does not remove certainty. Second, that it reaches five breastfeedings or more. Third, that it occurs within the two-year period. Since the question states that the mother of the girl mentioned that she breastfed the questioner, then she returned and mentioned that she was hesitant and doubtful about its occurrence, and that the mother of the boy denies breastfeeding absolutely, if there is no one who reports the breastfeeding with certainty, then the statement of the girl's mother that she breastfed the questioner, and her statement on another occasion that she is not certain and not sure of it, but rather she is hesitant and doubtful about the occurrence of breastfeeding from her—this statement of hers has no effect on the validity of the marriage contract
of the questioner with the daughter of his paternal cousin. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
