Machine translationRead the Arabic original
The second question of Fatwa No. ( 9578 )
Q2: What is the waiting period for the following categories, which you mentioned: 1- The divorced woman. 2- The menstruating woman. 3- The young girl. 4- The woman with post-natal bleeding. 5- The pregnant woman. 6- The woman with irregular bleeding. 7- The woman who has stopped menstruating .
A2: There are six categories of women in the waiting period:
The first category: The pregnant woman, and her waiting period, whether due to the death of her husband or divorce, is the delivery of the full pregnancy; based on the saying of Allah the Exalted:
And for those who are pregnant, their term is until they give birthوَأُولاتُ الأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[At-Talaq 65:4]
The second category: The woman whose husband has died, not being pregnant, and her waiting period is four months and ten days from the time of his death; based on His saying the Exalted:
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days]وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
[Al-Baqarah 2:234]
The third category: The menstruating woman, and her waiting period from divorce or annulment is three menstrual cycles; based on His saying the Exalted:
Divorced women remain in waiting for three periodsوَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلاثَةَ قُرُوءٍ
[Al-Baqarah 2:228]
The fourth category: The woman who does not menstruate, either due to youth or old age, and her waiting period is three months; based on His saying the Exalted:
And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruatedوَاللائِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسَائِكُمْ إِنِ ارْتَبْتُمْ فَعِدَّتُهُنَّ ثَلاثَةُ أَشْهُرٍ وَاللائِي لَمْ يَحِضْنَ
[At-Talaq 65:4]
And similar to her is
the woman with irregular bleeding. The fifth category: The woman whose menstruation has ceased and she does not know what caused it to cease, and her waiting period is one year; based on the statement of al-Shafi'i that this was the judgment of 'Umar between the Muhajireen and the Ansar , and none of them whom we know of denied it. The sixth category: The wife of the missing man, and she observes a waiting period of four months and ten days, the waiting period for death, after the period of waiting for his return. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
