Q2: Is it permissible for witnesses to testify contrary to the facts, such as testifying that so-and-so placed his hand on such-and-such land from such-and-such date, when he did not place it on that date?
A2: It is not permissible for a Muslim to give such testimony because it contradicts the facts, and its giver falls under the warning regarding those who give false testimony or utter falsehood. Allah the Exalted said:
So avoid the uncleanliness of idols and avoid false statement,فَاجْتَنِبُوا الرِّجْسَ مِنَ الأَوْثَانِ وَاجْتَنِبُوا قَوْلَ الزُّورِ
[Al-Hajj 22:30]
, and it was narrated from Abu Bakrah (may Allah be pleased with him) that he said: The Messenger of Allah (peace and blessings be upon him) said:
"Shall I not inform you of the biggest of the great sins?" We said, "Yes, O Allah's Messenger (ﷺ)" He said, "To join partners in worship with Allah: to be undutiful to one's parents." The Prophet (ﷺ) sat up after he had been reclining and added, "And I warn you against giving forged statement and a false witness; I warn you against giving a forged statement and a false witness." The Prophet kept on saying that warning till we thought that he would not stop.ألا أنبئكم بأكبر الكبائر، قلنا: بلى يا رسول الله، قال: الإشراك بالله، وعقوق الوالدين، وكان متكئا فجلس: فقال: ألا وقول الزور، ألا وشهادة الزور، فما زال يكررها حتى قلنا: ليته سكت
