Q: My father, may Allah forgive him, passed away on 26/3/1417 AH due to a traffic accident. He was a man of righteousness, goodness, and visible worship, and praise be to Allah the Exalted; however, like other human beings, he was not sinless. He was, may Allah have mercy on him, the mu'adhdhin for a mosque in one of the villages, where
only the people of two households used to pray. My father moved to a farm of his that is approximately thirty kilometers from this mosque, and he did not perform the adhan in this mosque for more than twenty years. I advised him many times to report this to the Waqf Authority, but he would reply to me by saying: "This is from the state's money, and it is rich enough without it," or words to that effect, may Allah have mercy on him. He now has a farm and some real estate, as well as cash amounts. The question is: Should the salary for the adhan for the period of twenty-two years be taken from the principal and used to build a mosque , since this money is from the Ministry of Waqf? Or should the entire money be distributed among the heirs, knowing that they are all adults and there are no minors among them? And should we receive his rights and add that salary to them? Please issue a ruling, may Allah reward you, and may Allah reward you with good. I hope this will be done quickly.

A: If the reality is as you mentioned in the question, it is obligatory to take out the entire amount your father received without right and spend it on the construction of one of the mosques, or to give it in charity to the poor. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
