Using another person's name and number in commercial transactions

Machine translationRead the Arabic original
Fatwa number ( 14307 )
Q1: I have a relative who has commercial transactions with some Bedouins and farmers, and his rights (debts) remain with them for multiples of the deferred period, with some exceeding five years. When he demands the amount, they excuse themselves by saying they do not have it, so they offer to deliver to him a truck loaded with grain at harvest time. He would then bring it in and deliver the grain to the silos in his name, as he owns a farm and has an account number with the General Organization for Grain Silos, which accepts what he delivers to them based on this number. He then receives the value of the grain from the silos after deducting zakat and the cost of renting the truck that transported the grain. If the value exceeds the amount owed, they return the excess to him. Is this permissible? Knowing that the one who grants the debtor (the farmer) the right to deliver the grain in his name, and then receive the amount and hand it over to the creditor, is that he has installments due to the Agricultural Bank or the Real Estate Development Fund. If it is delivered in his name, he will not receive anything, or he may receive it but the creditor cannot guarantee that he will pay it off. I ask for an answer, may Allah guide you.deliver the grain in his name is that he has installments due to the silosand then receiving the amount and handing it over to the creditor is that he has installments due to the Agricultural Bank or the Real Estate Development Fund. A1: If the matter is as mentioned, it is not permissible; because it is a disobedience to the one in authority, and Allah has commanded obedience to him.
Q2: I am a farmer and I have a number for my farm at the silos
in which the quantity that the silos decided to accept from me this year is specified, based on the farm's production last year. However, I did not plant this year. My neighbor or friend asked for my number to enter the silos with it and supply the quantity allocated to me by this card, due to the excess of his production beyond his allocation to supply to the silos, and for the speed of receiving the value, since the less the quantity supplied to the silos, the faster the receipt. What is your opinion, Your Eminence?

A2: It is not permissible for you to give your number at the silos to your neighbor or friend to enter with it and supply wheat in your name; because of the lying and the violation of the one in authority involved in that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
