Q1: A dispute occurred between a man and his wife while they were in the desert, in the open wilderness. After the dispute between them ended, the woman said to her husband: “I have a fast of three years upon me; I will not ride in your car nor walk with you,” then the man said to his wife: “I am not going to leave you in the wilderness where you have no one; ride in the car, and whatever it costs, I will pay it.” Then she rode in the car and walked with him. This is the exact wording of everyone, in the presence of everyone, with us. Please give us a ruling, may Allah reward you, regarding what is due upon the woman from her statement and what is due upon the husband from
his commitment to pay what is incurred for his wife? May Allah magnify your reward and recompense.
A1: If the situation is as described, where the wife committed to fasting for three years if she rode in the car and walked with her husband, and she broke her oath by riding with him in the car, then she must pay the expiation for an oath, and the husband must fulfill what is incumbent upon her regarding the expiation, in fulfillment of his commitment. The expiation here is: feeding ten poor people, five sa' (a dry measure of about 3 kg) of wheat, dates, rice, or the like of what his family eats, giving each of the ten half a sa', or clothing ten poor people, or freeing a believing slave. Performing any of these three things suffices. If she is unable to perform these three things, she must fast for three days, and it is better if they are consecutive. She is not obligated to fast for the three years she committed to, because her statement and similar statements are considered an oath. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
