Question:
If the one who was killed was killed by the killer by mistake, does the killer fall under the ruling?

Answer:
No, the killer owes nothing; he only owes the blood money and the expiation. Allah (Exalted and Majestic is He) made it clear:
And never is it for a believer to kill a believer except by mistake. And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to theوَمَا كَانَ لِمُؤْمِنٍ أَنْ يَقْتُلَ مُؤْمِنًا إِلَّا خَطَأً وَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ
[Al-Nisa:92]. He owes the blood money, and he owes the expiation. So, in order to emphasize the gravity of killing, the expiation was prescribed for it even though it was a mistake.
