The second question of Fatwa No. ( 16745 )
Q 2: My deceased brother before his death had struck a woman and she died,
and he was ruled to fast for two months, and after a short time he fell ill and died before fasting the two months, so who is obligated to fast on his behalf? Knowing that his eldest child is a daughter who is 17 years old.
A 2: The fasting of the two months that was obligatory upon your brother as an expiation for accidental killing, but he died before he was able to perform it, remains a debt in his estate, and no one is obligated to fast on his behalf, neither his children nor anyone else, but whoever volunteers to do so and fasts on his behalf will receive reward, and the deceased’s estate will be cleared of the debt, if Allah wills; based on the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 1147 It is agreed upon as authentic from the hadith of Aisha (may Allah be pleased with her), and the guardian is the close relative. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
