Fatwa No. ( 19543 )
Q: I have a disabled daughter who is 13 years and 5 months old. She cannot walk; she only crawls, and her health is deteriorating due to her weakness in eating. Despite this, by the grace of Allah, I am attentive to her care. I placed her in the bathtub in the bathroom and left her to splash around in it so I could wash her, as I do every day, and I went to the kitchen to work.
My intention was to return to her quickly, but I forgot about her. When I remembered, I went to see her and found that she had passed away . I was shocked and overcome with severe distress because of my negligence in remembering her. I ask your Eminence to inform me if I am required to do anything. May Allah preserve you and bless your days.
A: If the situation is as described, you must pay the expiation, which is: freeing a believing slave. If you are unable to do so, you must fast for two consecutive months. Additionally, your kin (‘aqlah) must pay the blood money to the heirs of the deceased if they demand it; based on the saying of Allah the Exalted:[An-Nisa 4:92] , up to His saying: [An-Nisa 4:92] . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charity
And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.
