Q: Allah decreed upon me on the day of 7/12/1408 AH, when I was returning from the city of Jizan to Jibal Fafa , where my family resides, and I intended to go to my mother’s house where my children reside. I wanted to take my children and bring them down with me to Jizan . At that time, my mother objected and said to me: The festival is near, and her desire in this was that I spend the festival with her, I and my children. I did not agree to her demands, but she remained silent. After a while, she said to me: Allah makes the truth prevail. I was not concerned with these words. I took my children and my wife and brought them down in a small car. When I reached the bottom of the mountain at the police station there, they informed me that there was a flood in the valley and advised me to stay until the flood ended so I could cross the valley. However, I did not listen to what they said, and I went down with the car along with my entire family. There was no flood in the valley at that time. When I reached the valley, the car got stuck, and people were shouting at me that the flood was coming. My wife was also trying to make me escape from that valley, as my attempt to get out with the car took no less than fifteen minutes. But unfortunately, the flood came, and at that time I was unable to get out all of my family. In this tragedy, the flood took from me my family, my wife, and six of my sons and daughters . Please inform me what is obligatory upon me in this case? May Allah reward you with good for us?
A: It is obligatory upon you seven expiations for causing the death of the seven members of your family who were with you. The expiation for each one is: freeing a believing slave. If you do not find one, then fast two consecutive months. Allah the Exalted said:
And never is it for a believer to kill a believer except by mistake. And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charityوَمَا كَانَ لِمُؤْمِنٍ أَنْ يَقْتُلَ مُؤْمِنًا إِلا خَطَأً وَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ إِلا أَنْ يَصَّدَّقُوا
[An-Nisa 4:92]
up to His saying:
And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ تَوْبَةً مِنَ اللَّهِ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا
[An-Nisa 4:92]
. And you must repent to Allah, Mighty and Majestic, for your negligence, your disobedience to your mother and to the advisors, and for not returning to such a situation. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
