Q: One of my companions from my specific tribe had an accident in which eight people died: five men and three women. He was the one at fault; he swerved with his car into another vehicle and struck this family, and Allah caused them to die. The blood money has been paid, and as for the remaining right of Allah, he is young in age and also does not know how to drive well. I tried to have him fast, but the number here is large. I wanted to present his case to you, as he instructed me to ask.
A: If the person mentioned was of age and sane at the time of the accident, the expiation is obligatory upon him
for each victim: freeing a believing slave. If he does not find one, then fasting two consecutive months. However, if he had not reached puberty at the time of the accident, there is no expiation upon him according to the most correct of the scholars' opinions; based on the saying of the Prophet (peace and blessings be upon him): Puberty for a male is achieved by completing fifteen years of age, or by the growth of coarse hair around the private parts, or by the emission of semen due to desire. For a woman, a fourth matter is added, which is menstruation. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
