Q: Allah decreed that my son kill a person, and we were ordered to pay blood money because the boy is a minor, being 13 years, 5 months, and 20 days old. Then, the honorable head of the courts of 'Asir ruled that he must free a slave or fast for two months, as stated in the Qur'an. I am a man suffering from several illnesses, including high blood pressure and diabetes, and I cannot even complete Ramadan; I fast one day and break the fast the next. I seek from Allah, and then from you, a ruling, as fasting is required of me, knowing that I am unable to pay the value of freeing a slave.
A: There is no expiation upon you. As for the killer, if he does not have any sign of puberty, such as the emission of semen or the growth of coarse hair around the private parts, then he is not accountable, and expiation is not obligatory upon him; rather, the blood money is upon the 'aqilah (the paternal clan). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
