Q: My mother (F. Y. S.) dropped a stone on our sister, who was very young, while we and she were collecting rainwater for us, and this resulted in the girl’s immediate death. My mother has passed away without having made expiation, and she did not know about the sin upon her. Therefore, I ask you to issue a ruling on what I should do.
A: It appears that your mother dropped a stone on your young sister by mistake while she was working to bring you water from the rain, which caused her death. If that is the case, then it is obligatory for her to make expiation; and that is
freeing a believing slave. If she does not find one, then she must fast two consecutive months; because she caused the death of this child. Since this woman passed away without making expiation due to her ignorance, it is obligatory that the price of freeing a believing slave be paid from her estate if she has money. If she has no money and one of her children or relatives volunteers to free a slave on her behalf, if a slave is found and it is facilitated, or to fast two consecutive months (sixty days) on her behalf, then he will have reward from Allah the Exalted; because this is a debt upon your mother, and her conscience should be cleared of it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
