Q: A woman asks, saying: She was pregnant in her ninth month, and they had a water tap, meaning a square-shaped tank made of white tin, with a capacity of one cubic meter of water. The questioner says: The water in this tank would decrease to half, which forced her to press her belly against the tank to draw water from it. After three days, she felt that her fetus was not moving in her belly, so she presented herself to the doctor, who found her fetus dead in her belly and it was extracted. However, the questioner fears that she is the cause of her fetus’s death in her belly, and she wants to remove
the doubt with certainty. Does she have to pay an expiation? She does not know the cause of her fetus’s death in her belly. Please answer us in writing, may Allah reward you for us and for Islam and the Muslims with all good.
A: It is obligatory for the woman mentioned to pay the expiation for accidental killing because she caused the death of her fetus. The expiation is freeing a believing slave; if she does not find one, she must fast two consecutive months (sixty days). Menstruation does not break the consecutiveness, and she must fast in place of the days of menstruation, consecutively, until she completes the sixty days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
