Q: I am married (E. J. M. D.), and the aforementioned man has fathered twenty-three children with me, both daughters and sons. Eight of them have passed away, and fifteen remain. I miscarried with twins because of his treatment of me. He is negligent in my rights; he kicks me with his foot and insults me in front of my children and his second wife. I have been silent regarding the miscarriage for two months, and two months remain. I seek your ruling on this, knowing that he neglects me and his children are with his other wife, and Allah knows my condition. I seek your ruling on the miscarriage and on my fasting: should I complete the two months, or is what I have fasted sufficient?
A: If you were the cause of the miscarriage of the aforementioned two fetuses through aggression or negligence, and it occurred after the soul was breathed into them, then you owe an expiation. It is: freeing a believing slave for each of them. If that is not possible, then fasting two consecutive months for each of them. If the miscarriage did not occur due to your action, or if the miscarriage occurred before the soul was breathed into them—that is, before they entered
the fifth month—then you owe nothing. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
