Fatwa number ( 18788 )
Q: I went out on a rainy night on the evening of Wednesday, corresponding to 19/1/1417 AH, and I stopped my car on the right side of the road, and I got out of it to watch the flash floods come down. So a motorcyclist came, and he was driving it without front lights, and he hit the rear of the car
which was parked, and I was not in it, then he fell on the asphalt next to the car, so I rushed him to the hospital, and after four hours he died. The traffic department handled the accident and determined that 25% of the fault was on me because I did not use the turn signals. So, is the expiation obligatory upon me?

A: If the situation is as you described, then the expiation is obligatory upon you, and it is: freeing a believing slave. If you do not find one, then you fast two consecutive months; for Allah the Exalted said:
And whoever kills a believer by mistake - then the freeing of a believing slaveوَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ
[An-Nisa 4:92]
, to His saying:
then [instead], a fast for two months consecutivelyفَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ
[An-Nisa 4:92]
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
