Fatwa number ( 16891 )
Q: I inform Your Eminence that I am an employee of the police in al-Qunfudhah , and I perform patrol duties. On the date 18 \ 9 \ 1407 AH, at exactly two and a half in the morning, I was on patrol with a colleague from the al-Qunfudhah district , to the al-Muzaylif district . While we were traveling on the main asphalt road, we saw a group of camels on both sides of the road, so I stopped the rescue vehicle on the side of the road, and my colleague remained in the vehicle while I got out to move the camels away from the road after ensuring the road was clear of cars. I drove them, and they crossed the road, except for one camel that stopped in the middle of the road. I was ten meters away from it. While it was standing there, I threw stones at it to move it away from the road. During that, a car came and collided with it, and then collided with the rescue vehicle that was parked next to the asphalt line, and my colleague was standing next to the rescue vehicle, and the accident resulted in the death of my colleague who was performing patrol duties with me. And I, O
Owner of Eminence, have not had peace of mind since that accident, because the traffic department determined that the full percentage of fault lies with the one who collided with the camels that were standing on the asphalt line, which I had driven, but I fear that I have a share in this accident due to my driving of the camels, and my intention was to seek reward, not to incur sin. I hope Your Eminence will issue a fatwa to me: is there anything upon me in the aforementioned accident, such as an expiation or otherwise? Knowing that the driver who was held liable has paid the blood money. May Allah preserve you
A: If the reality is as you mentioned in your question, then there is nothing upon you; because you did not kill and you did not cause the killing, and the one who caused it is the owner of the car who caused the accident. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
